A Roetzel Business Litigation Update

Alert | Business and Commercial Litigation Alert

Ronald B. Lee and Chris Cotter, members of the Roetzel & Andress litigation team, received a defense verdict for a multi-national company with plants in Ohio on September 14, 2016, in the United States District Court for the Northern District of Ohio. The case was tried before the Honorable Judge James Gwin, and concerned a serious injury to an employee that ended his career as a machinist. The case involved allegations of intentional misconduct and a request for punitive damages. The trial was a typical trial before the court that was fast-paced and was completed in a mere two-and-a-half-days. The proceedings began with the Plaintiffs changing their theory on the first day of trial.

The jury was unanimous in rendering a defense verdict after 45 minutes of deliberations. Opposing counsel were seasoned trial lawyers that presented a very emotional case. The defense prevailed over the raw emotion generated by a man that lost his livelihood after 38 years of service by focusing on the facts, while still sympathizing with the plight of the Plaintiff.
